DIY Building A Deck

20 acres of public land can be staked out and ‘claimed’ for $100 yearly fee. Can I legally build on this land?

Mining Act of 1872 allows any American citizen and even foreign corporations to drive four stakes into the ground at the corners of government owned public land in most western states and apply for a patent (title) on the land. You can apply for as many as you like and pay a yearly $100 fee for the land.

Would I be able to stake our 50 or 100 of these 20 acre parcels and build homes on these sites, sell them at a profit?

Has anyone actually done this yet?

I know there is a patent moratorium that is renewed by Congress every year, but that just stops you from buying the title to the land at $5 per acre, but you can still pay the $100 yearly per 20 acre plot. The big question remains:

Is this legal?

I have never heard of this, but I will advise you to call your county clerk or regsitrar of deeds and ask them. They will know.

The cave was apparently discovered in the 1930s by a passing boater. After several unsuccessful attempts by others to mine the nitrogen-rich guano for fertilizer, the U.S. Guano Corporation bought the property around 1957. Based on a reputable mining engineer ’s estimate that the cave contained 100,000 tons of guano, the company constructed an elaborate plant to extract the guano. A small airstrip was built on a nearby sandbar in the Colorado River , and all supplies and machinery needed were then flown in. An aerial tramway was built from the mine to “Guano Point” on the South Rim, with the cable headhouse built on land leased from the Hualapai tribe. The cableway crossed the river, with a main span of 7,500 feet (2,300 m), and a vertical lift of 2,500 feet (760 m). About 6 miles (9.7 km) (30,000 feet (9,100 m)) of 1.5 inches (38 mm) steel cable were used, to support and pull a cable car large enough to transport 2,500 pounds (1,100 kg) of guano. The same car was used to transport the miners to and from work. The guano was mined using a large industrial “vacuum-cleaner” with ten-inch hoses.
